This article is concerned with the situation where bad financial advice is given to an intending settlor to constitute a trust or to trustees in the exercise of their powers under an existing trust. When this advice turns out to have adverse financial consequences for the trust, are the settlor and trustees left to claims against the adviser for breach of contract, or can the settlement or exercise of the power be set aside?

Questo articolo tratta il caso in cui chi sta per istituire un trust oppure il trustee che sta per esercitare un proprio potere riceve un parere professionale errato. Quando emerge che avere seguito questo parere ha prodotto effetti dannosi per il trust, il disponente o rispettivamente il trustee può solo agire contro il professionista che ha espresso il parere o può il negozio compiuto sulla base di quel parere essere dichiarato privo di effetti?
