A fronte di una base legale poco determinata e dell’incidenza sui diritti costituzionali che l’informazione interdittiva antimafia comporta, dovrebbe essere richiesta una valutazione più rigorosa degli elementi che costituiscono il quadro indiziario ogniqualvolta l’autorità ricorra ad elementi indizianti non codificati, con un onere motivazionale rafforzato.

The author’s view

Considering that the legal foundation of the anti-mafia information does not satisfy the requirement of certainty, and in view of the impact on constitutional rights posed by these prohibitions, a more stringent assessment of the evidence and a stronger justification is necessary whenever the authorities use uncodified elements to determine the risk of mafia infiltration attempts.
