Gli obblighi fiduciari discendenti dalla tutela costituzionale dell’interesse delle generazioni future possono avere implicazioni anche in materia di trust interno, con riguardo alle posizioni dei beneficiari non ancora nati né concepiti.

Se la loro sussistenza sostanziale appare già nitida, la tutela processuale richiede il rafforzamento del ruolo del giudice interno sul modello della inherent jurisdiction dei paesi d’origine.

The fiduciary obligations flowing from the constitutional protection of future generations’ interests may also have implications for domestic trusts with regard to the positions of beneficiaries not yet born or conceived.

If their substantive existence already appears clear, procedural protection requires strengthening the role of the domestic court on the model of the inherent jurisdiction of the countries of origin.
