Un atto di destinazione, contenente una procura a gestire il patrimonio destinato a favore di un soggetto terzo, non è sufficiente a far sorgere a carico della Banca un obbligo di vigilanza sulle operazioni compiute dal gestore sul conto corrente oggetto della procura. Un atto di destinazione, alla luce di quanto stabilito dall’art. 2645-ter cod. civ., non può far sorgere un vincolo di destinazione in relazione a beni mobili che non prevedono particolari forme di pubblicità idonee a rendere conoscibile il vincolo all’esterno, come il denaro. Esclusivamente in presenza di evidenti “anomalie”, l’intermediario bancario sarà tenuto ad informare il titolare del conto corrente ma non potrà, invece, impedire l’esecuzione dell’operazione richiesta dal gestore.

The author’s view

A deed of destination, containing a power of attorney to manage the earmarked assets in favor of a third party, is not sufficient to give rise to an obligation on the part of the Bank to supervise the transactions carried out by the manager on the current account subject to the power of attorney. A deed of destination, in light of the provisions of Article 2645-ter of the Civil Code, cannot give rise to a restriction of destination in relation to movable assets that do not provide for special forms of publicity suitable for making the restriction knowable to the outside world, such as money. Exclusively in the presence of obvious "anomalies," the banking intermediary will be required to inform the account holder but may not, however, prevent the execution of the transaction requested by the manager.
