Validità ed effetti delle clausole in terrorem

La struttura del testamento che produce effetti solo dopo la morte del de cuius, non assicura che le sue volontà vengano rispettate, essendo sempre possibile che sia gli eredi sia i legatari possano disattendere il programma di devoluzione delineato dallo stesso testatore. Ciò è ancora più vero con riferimento alle clausole penali contenute in un testamento.

Il contributo intende mettere a confronto tali clausole con le clausole in terrorem previste nell’ordinamento americano.

The author’s view

The structure of the will that produces effects only after the death of the deceased, does not ensure that his/her wishes are respected. Actually, either the heirs and the legatees may disregard the devolution program outlined by the testator/testatrix in the will. This is even more true as far as penalty clauses possibly contained in a will are concerned.

The purpose of this essay is to compare said penalty clauses admitted under Italian law with the clauses in terrorem provided for by the laws applicable in the United States of America.
